WAIVER

Effective as of date of agreement

1. PURPOSE AND NATURE OF PARTICIPATION

I acknowledge that my participation in any physical, spiritual, or wellness activities offered by The Element Room at 15581 Deerfield St., Sterling, CO 80751, is entirely voluntary and conducted within a private ecclesiastical association dedicated to mind-body-spirit wellness. I understand this is not a public commercial service but a private membership activity under Atomic Puppies, a 508(c)(1)(a) Ecclesiastical Trust.

2. ASSUMPTION OF RISK

I freely accept the inherent risks of physical and mental activity, including but not limited to: muscular strain, joint injury, dizziness, cardiovascular issues, emotional stress, falls, or equipment accidents.
I release The Element Room, its trustees, instructors, and affiliates (“Released Parties”) from any liability for injury or loss, whether known or unknown, arising from my participation.

3. HEALTH AND MEDICAL CONDITIONS

I affirm that I am in good health, have disclosed any relevant medical concerns, and will participate at a level appropriate to my ability.
Pregnancy Notice: If I am pregnant, become pregnant, or am postnatal, I understand participation carries risks (including miscarriage or complications) and agree participation is solely at my own risk after consulting a physician.

4. NO REFUNDS & MEMBERSHIP COMMITMENT

All payments, class packs, and memberships are final and non-refundable.

• Founding and Monthly Memberships require a minimum three-month commitment from enrollment.

• After three months, memberships may be canceled with 14 days’ notice before the next billing cycle.

• Missed or unused classes are non-transferable and non-creditable.

• The Element Room reserves the right to change class times, capacity, or offerings without notice.

All financial contributions are considered voluntary donations in exchange for participation in private spiritual-wellness activities, not commercial sales.

5. FACILITY & PARKING

Parking is located around back in the alley, in the rear driveway or along the fence line. Overflow parking is available in front via the side path.
The Element Room assumes no responsibility for loss, theft, or damage to vehicles or personal property.
No restroom facilities are available on-site.

6. MEDIA RELEASE

I grant The Element Room permission to photograph or record classes and use images or video for educational or promotional purposes without compensation.

7. CONDUCT & PARTICIPATION POLICY

I agree to follow all instructor guidance and studio rules. The Element Room reserves the right to refuse participation or revoke membership at any time for behavior deemed unsafe or disruptive.

8. AGE REQUIREMENT

Participants must be 18 years or older. Ages 13–17 may attend with a parent or guardian present and a signed minor waiver. Children under 13 are not permitted except for family-designated events.

9. GOVERNING LAW

This Agreement is governed by the laws of Colorado, and any disputes shall be resolved in Logan County, CO.

10. ACKNOWLEDGMENT & DIGITAL SIGNATURE

By booking an appointment, class, or membership through Square Appointments, I acknowledge that I have read, understood, and agree to this Waiver and Membership Agreement. I understand my booking and participation serve as my digital signature and acceptance of these terms.

By booking a class or membership with The Element Room, you acknowledge and agree to this Participant Waiver & Membership Agreement. All sales are final. Founding and monthly memberships require a three-month minimum commitment. No refunds.

The Element Room reserves the right to deny participation or entry to any individuals who do not meet these requirements.
